Marshal.4.8.Z is out of date
Noticed recently that this doesn't seem to include newer gems and versions.
Heading the s3 object I can see the last-modified is Mon, 08 Feb 2010 08:25:51 GMT
Should I be using something else or is the lack of updates an unintended omission?

It's unintended. The main problem is that the legacy marshal index wants dependencies, and gemcutter allows gems to be pushed with bad dependencies, which breaks gems#show and the legacy indexing process. My plan is to fix the root cause of this soon so this stops happening.

This should be up to date now and from now on should be updated daily. Let me know if there's any other problems with it.
