Claiming name for unavailable gem?

I'm trying to publish a gem that apparently conflicts with a name of a gem that someone else published and yanked. Is there a process for claiming that name, since there's not any publicly-available version of the gem, or should I just change my gem name?

http://rubygems.org/gems/manticore is the gem in question. I'm pretty sure it's completely unavailable, as gem fetch can't find it:

gem fetch manticore
ERROR:  Could not find a valid gem 'manticore' (>= 0) in any repository

    You should just be able to publish any gem version except what's there it
    to take it over! Should be easy. :)
